For most public land the answer is yes, I am allowed to be there, I have permission to be there. Some public entities have policies in place that must be followed. Others have chosen not to put a policy in place. As long as I don't break a policy, I don't see why I can hide a cache on public property. As you might notice private property is different. Explicit permission is a must in all cases. That kills more Walmart caches that we fortunately don't see too much in STL.
